In our June 2026 Quarterly HR Update we provided an update about the Immigrant Worker Protection Act (IWPA), outlining new notification requirements employers must comply with as of October 1, 2026, relating to I-9 audit inspections by Homeland Security Investigations (HSI).

The Washington Attorney General’s Office has now released several documents that employers should be aware of: a workplace poster, model notices, and employer guidance. All these documents are provided in English, Spanish, Russian, Vietnamese, Ukrainian, and Chinese-Mandarin and can be accessed here.

Employer Action Required!

While many of the requirements of this Act only apply if an employer receives notice of a Form I-9 inspection, employers must take action by October 1st on the following:

  • Designate on the poster, how you will notify each worker of an I-9 inspection, how you will notify each work of any deficiencies identified during the inspection, and the location(s) where notices of any inspections will be posted. Notification methods include text, email, hand delivery, or “other”.
